Individual Smoking & Health Cases
The first individual smoking-and-health case in the United States was filed in 1954; the first trial was in 1960. During the next four decades, individual case trial activity ebbed and flowed. Beginning in approximately 1999, however, trial activity in individual cases became and remained fairly steady.
Our Viewpoint
- Smokers have long been aware that smoking is dangerous to health and choose to smoke despite that knowledge.
- After seeing the evidence in court, most jurors continue to apply their common sense and believe that smokers who choose to smoke despite knowing that smoking is dangerous should not be financially rewarded.
